School Subscription Terms
Goomp Goomp Country© · Draft, October 2026
These terms set out how a school may use Goomp Goomp Country© under a paid subscription, and what each side agrees to.
1. About these terms
1.1These terms are an agreement between Goomp Goomp Books ([legal name], ABN 82 423 130 137) (we, us) and the school or organisation named on the Order (you).
1.2The agreement is made up of these terms, the Schedule and the Order. If they conflict, the Order applies first, then the Schedule, then these terms.
1.3You accept these terms when you sign or accept the Order, pay the first invoice, or first use the Game under a subscription.

2. Your subscription and licence
2.1For the Subscription Period, and while you pay the Fees, we give you a non-exclusive, non-transferable licence for your Authorised Users to use the Game for teaching and learning.
2.2The licence covers the number of classes, students and sites set out for your Plan in the Schedule. You may ask to move to a larger Plan at any time; the extra Fees are pro-rated for the rest of the Subscription Period.
2.3You may install the Game on devices you own or manage, and on students' own devices for school learning, as long as only Authorised Users use it.
2.4The licence is for educational use at or through your school, including homework and home practice. It does not cover public performance, resale, or use by another school or organisation.
2.5We may change the Game's features over time. We will not make a change during your Subscription Period that substantially reduces what your Plan includes without giving you the option to end the subscription and receive a pro-rata refund.
3. Fees, payment and renewal
3.1You must pay the Fees for your Plan as set out in the Order. Fees are in Australian dollars and include GST. We will give you a valid tax invoice.
3.2Invoices are payable within 30 days, or within the time set by your school's or department's purchasing rules if we agree to that in writing.
3.3If an invoice is more than 30 days overdue, we may send a reminder. If it remains unpaid 14 days after that reminder, we may suspend access under clause 10.
3.4Fees for a Subscription Period are fixed for that period. We will give you at least 60 days' notice of any change to Fees for the next period.
3.5Your subscription does not renew automatically. We will contact you at least 60 days before it ends with a renewal quote. If you renew, the new period starts the day after the old one ends.
3.6Fees are not refundable, except where these terms or the law say otherwise (including under clauses 2.5 and 9).
4. Accounts, classes and the Teacher's Panel
4.1You will nominate a contact person to manage the subscription and teacher accounts.
4.2Teachers create classes in the Teacher's Panel. Students join a class with a class code; they do not need an email address or a personal account.
4.3Students should be identified by first name, nickname or another identifier chosen by the school. Do not enter students' full names, dates of birth or other sensitive details.
4.4You are responsible for:
- keeping teacher logins and class codes within your school;
- making sure only Authorised Users use the Game;
- removing teachers and students who leave the school; and
- supervising students' use of the Game in line with your school's policies.
4.5Tell us promptly if you believe a login or class code has been misused.
5. Acceptable use
5.1You and your Authorised Users must not:
- copy, share, sell, lend or distribute the Game, or give access to anyone outside your Plan;
- copy, extract or download the Game's recordings, artwork, word lists or other content, except as clause 5.2 allows;
- change, translate, decompile or reverse engineer the Game, or try to get around its access controls;
- use any part of the Game, including the voice recordings, to train, test or improve any artificial intelligence or machine learning system;
- use the Cultural Material in a way that is disrespectful, misleading or inconsistent with clause 6; or
- use the Game for any unlawful purpose.
5.2Teachers may display the Game in class, and may quote individual Yugambeh words and short phrases in lesson materials for their own students, with the credit "From Goomp Goomp Country©, Goomp Goomp Books".
6. Ownership and Yugambeh cultural property
6.1The Game, its code, design, recordings, artwork, text and the name "Goomp Goomp Country" are owned by or licensed to us. This agreement gives you a licence to use them; it does not transfer ownership of anything to you.
6.2The Yugambeh language, and the stories and knowledge in the Game, belong to Yugambeh people. They are shared in the Game with permission and in line with the Goomp Goomp Country© Cultural Protocols. Nothing in this agreement gives you or us ownership of that cultural heritage.
6.3The Gibamyeri script is the cultural and intellectual property of its creator, Shaun Davies ALing. It may not be reproduced outside the Game except as clause 5.2 allows.
6.4Voice recordings in the Game remain the property of the speakers who made them, and are used with their consent.
6.5When teaching with the Game, you agree to:
- present the language as Yugambeh language, shared by the Yugambeh community;
- respect any cultural notices in the Game, including notices about people who have passed away; and
- tell us if you see anything in the Game that may be culturally inaccurate or inappropriate, so it can be reviewed.
6.6If you send us suggestions or feedback, we may use them to improve the Game without owing you anything.
7.1We collect only what the Game needs to work. Student Data is limited to:
| Information |
Why we hold it |
| Student's first name, nickname or school identifier |
So teachers can see whose progress is whose |
| Class code and class name |
To group students into classes |
| Learning progress (words met, review history, stage reached, words slipping, game progress) |
To run the learning system and the Teacher's Panel |
| Speaking practice recordings, only when the teacher turns on saving speaking for the class |
Evidence for assessment; kept with the class, deleted when the student or class is deleted, and no later than 12 months after the end of the school year |
| Teacher name and school email address |
To give teachers access and contact the school |
7.2We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and our privacy policy at goompgoomp.com/privacy.
7.3We will not:
- sell or rent Student Data;
- use Student Data for advertising, or show advertising in the Game;
- use Student Data to train artificial intelligence systems; or
- share Student Data with anyone except service providers who help us run the Game, under confidentiality obligations.
7.4Student Data is stored in Australia (Amazon Web Services, Sydney). We use reasonable security measures to protect it.
7.5You may ask us at any time to give you a copy of your school's Student Data, or to delete it. We will do so within 30 days.
7.6If we become aware of a data breach that affects your Student Data, we will tell you promptly, and will meet our obligations under the Notifiable Data Breaches scheme.
7.7You are responsible for telling parents and carers about the Game in line with your school's policies, and for obtaining any consents your school or department requires.
7.8The Game has no open chat, and students cannot message or see other students' information.
8. Devices, support and classification
8.1The Game runs in a current web browser on computers, tablets and phones, and can be installed as an app. It is designed for typical Queensland school laptops and tablets. Minimum requirements are listed in the Schedule.
8.2Once installed, the Game can be played without an internet connection. The Teacher's Panel needs a connection to update student progress.
8.3You are responsible for your devices, network and internet access, including allowing the Game through your school's filters.
8.4We provide support by email at admin@goompgoomp.com, between 8am and 4pm (Brisbane time) on school days during Queensland school terms, and aim to reply within 2 school days.
8.5We aim to keep the Game and Teacher's Panel available at all times, but do not promise uninterrupted access. Where we can, we will schedule maintenance outside school hours and give notice of planned outages.
8.6Updates, new words and new content released during your Subscription Period are included in your Fees.
8.7We have self-assessed the Game as exempt from classification under section 6B of the Classification (Publications, Films and Computer Games) Act 1995 (Cth), as an educational game likely to be classified G or PG. It contains no advertising, in-game purchases or simulated gambling. Details are in the Goomp Goomp Country© Gameplay Book.
9. Your rights under the law, and our liability
9.1Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded.
9.2We promise that the Game will substantially work as described in the Gameplay Book and on our website, and that we have the right to license it to you.
9.3If the Game does not substantially work as described and we cannot fix it within a reasonable time after you tell us, you may end the subscription and we will refund the Fees for the unused part of the Subscription Period.
9.4The Game supports language learning. It does not replace learning from Yugambeh Elders and community, and we do not promise any particular learning outcome.
9.5To the extent the law allows:
- we are not liable for any indirect or consequential loss, including loss of data you could reasonably have backed up;
- where our liability for a failure to meet a consumer guarantee can be limited, it is limited to supplying the Game again or paying the cost of having it supplied again; and
- our total liability under this agreement is limited to the Fees you paid in the 12 months before the claim.
9.6Neither of us is liable for a failure caused by something beyond our reasonable control, such as a natural disaster or a widespread internet outage.
10. Suspension and ending the subscription
10.1We may suspend access to the Teacher's Panel and school accounts if Fees remain unpaid as described in clause 3.3, or if there is a serious breach of clause 5 or 6. We will give you notice and a reasonable chance to fix the problem first, unless urgent action is needed to protect students, the Cultural Material or the Game.
10.2Either of us may end the agreement by written notice if the other seriously breaches it and does not fix the breach within 30 days of being asked to.
10.3You may end the subscription at any time by written notice. Fees already paid are refundable only as these terms or the law provide.
10.4When the subscription ends:
- your licence to use the Game under the Plan ends;
- you may ask for a copy of your school's Student Data within 30 days; and
- we will delete your school's Student Data within 90 days, unless the law requires us to keep it.
10.5Clauses 5, 6, 7, 9 and 11 continue to apply after the agreement ends.
11. Changes, disputes and general terms
11.1We may update these terms for future Subscription Periods. Changes will not apply to a current Subscription Period unless you agree in writing.
11.2If a dispute arises, the contact people for each side will first try to resolve it in good faith. If it is not resolved within 30 days, either side may refer it to mediation before starting court proceedings, except where urgent relief is needed.
11.3This agreement is governed by the laws of Queensland, and both sides accept the jurisdiction of the courts of Queensland.
11.4You may not transfer this agreement without our written consent. We may transfer it to another entity that takes over the Game, if we tell you in writing and your rights are not reduced.
11.5Notices must be in writing and may be sent by email to the contact addresses in the Order.
11.6If any part of this agreement is unenforceable, the rest continues to apply.
11.7This agreement is the whole agreement between us about the Game. If your school or department requires its own purchase terms, those terms apply only where we have agreed to them in writing.
